New Canada Spousal Open Work Permit (SOWP) Eligibility in 2024: 



Immigration, Refugees, and Citizenship Canada (IRCC) published revised eligibility rules for the Spousal Open Work Permit (SOWP) today.
These new restrictions go into effect today, March 19, 2024.

This was a much-needed clarification following the Immigration Minister's announcement of new restrictions for overseas students in early 2024.

Initially advertised as new adjustments to SOWP "within coming weeks," they are now fully in effect.

What are the new eligibility criteria for Canada's Spousal Open Work Permit in 2024?
International students' spouses or partners who want to apply for an open work permit as a spouse or common-law partner must meet the following qualifications.

Effective March 19, 2024, the spouse or common-law partner of an overseas student can now apply for an open work permit under three different circumstances.

1. If the spouse or common-law partner apply for an open work permit on or after March 19, 2024.

Starting March 19, 2024, if you are enrolled in classes for one of the professional degrees and have a valid study permit, your spouse or common-law partner may be eligible for an open work permit.

A university professional degree program, such as a master's or PhD program, or one of the following at a polytechnic institution:

Dental Surgery Doctor (DDS, DMD)
Juris Doctor or Bachelor of Laws (LLB, JD, BCL)
Medical doctor (MD).
Doctor of Pharmacy (PharmD, BS, BSc, BPharm), Doctor of Optometry (OD)
Veterinary Medicine Doctor (DVM)
Nursing Bachelor of Science (BSN, BSN, or BNSc)
Education Bachelor's Degree (B.Ed.
Engineering Bachelor's Degree (B. Eng., BE, BASc).

To establish your enrollment in a degree-granting program of study, your spouse or common-law partner must provide one of the following documents:

A verified letter of acceptance from your preferred educational institution (DLI).
A letter of verification of enrollment from your DLI
Transcripts from the current show
Proof of their relationship with the student.

2. If the spouse or common-law partner files for an open work permit by March 19, 2024.

If your spouse or common-law partner applied for an open work permit before March 19, 2024.

Your spouse or common-law partner may be eligible for an open work permit if you meet the following three conditions:

You hold a valid study permission.
Your current study program qualifies for a post-graduate work permit (PGWP).
As a full-time student, you can attend one of the following educational institutions:

A public post-secondary institution, such as a college or university or CEGEP in Quebec, a private college-level school in Quebec, or a Canadian private school that can lawfully issue degrees under provincial law (e.g., bachelor's, master's, or doctoral degrees).

3. If your partner or spouse wish to seek for an extension of their current open work permit,

You hold a valid study permission.
Your current study program qualifies for a post-graduate work permit (PGWP).
As a full-time student, you can attend one of the following educational institutions:
a public postsecondary school, such as a college or university, or CEGEP in Quebec.
A private college-level institution in Quebec or a Canadian private school authorized to offer degrees under provincial law (e.g., bachelor's, master's, or doctoral degrees).

Most of the time, the validity of the spousal open work permit corresponds to the period of their husband's or wife's study visa.

What is the Canadian spousal open work permit?
The spousal open work permit enables the spouse or common-law partner of an international student in Canada to work for any employer without the need for an LMIA or a job offer.
